The legal fight over President Trump’s current tariff measures has intensified, injecting fresh uncertainty into an already fragile global trading landscape.
Earlier this month, the US Court of International Trade dealt a major blow to the administration by ruling that the temporary 10% tariffs introduced in January were not legally justified. In its decision, the court stated that the duties imposed on the plaintiffs exceeded the authority granted under US law.
Despite the ruling, the tariffs remain in place for now after a federal appeals court granted a temporary administrative stay. The pause gives the government additional time to present its case as the dispute moves through the appeals process.
At the heart of the case is a constitutional and statutory debate over presidential trade powers. The administration introduced the tariffs under Section 122 of the Trade Act of 1974, but a coalition of 24 US states argues that the White House overstepped the limits of that authority.
The legal challenge has reignited comparisons with previous disputes over tariffs imposed under the International Emergency Economic Powers Act (IEEPA). In those earlier cases, courts ultimately ruled against the administration, paving the way for substantial reimbursement claims from affected companies.
Even if the current measures survive the legal scrutiny, their lifespan may still be limited. Section 122 only allows temporary trade restrictions for up to 150 days unless Congress authorises an extension, placing the current tariffs on course to expire in July.
Nevertheless, the administration appears prepared to continue pursuing its broader trade strategy. Reports suggest President Trump’s team is already exploring alternative mechanisms, including the possible use of Section 301 powers, to introduce new tariffs if required.
