Will The Supreme Court Overturn Trump’s Tariff Policies?

This month, the U.S. Supreme Court heard the Trump administration’s appeal of two lower-court decisions that found its expansive tariff program unlawful.

At the heart of the dispute are the Liberation Day Tariffs, introduced under the International Emergency Economic Powers Act (IEEPA). Declaring a ‘national emergency’ linked to the US trade deficit, President Trump issued a series of executive orders that placed targeted tariffs on more than 90 countries, along with a near-universal 10% baseline tariff on remaining imports.

The legal challenge focuses on whether the president had the authority to impose such sweeping tariffs without congressional approval.

In May, a Federal Court ruled that Trump had exceeded the powers granted by IEEPA when implementing much of the tariff regime. The US Court of Appeals agreed with that conclusion in August, finding that the administration’s use of emergency economic powers went far beyond what Congress intended. The Trump administration is now asking the Supreme Court to overturn those decisions.

The Court heard oral arguments on November 5th and has until June 2026 to issue its ruling, though many expect a decision earlier – potentially by January.

Before the hearing, observers viewed the case as evenly balanced. However, pointed skepticism from several justices during oral arguments has shifted expectations slightly toward a Trump loss.

If the appeal is rejected, the case would likely return to Federal Court to determine the next steps. The government could be compelled to refund a substantial share of roughly $100–120 billion collected through the tariffs so far, and trade arrangements built around the program might also be undone.

Should the Supreme Court uphold the lower courts’ findings, the administration would have no remaining judicial options and would need to seek approval from Congress to reinstate the tariffs – a politically difficult path, particularly given that these emergency powers were invoked to bypass Congress in the first place.
